Indigo offers a range of services (“Services”) consisting of the services offered by Indigo or its subsidiaries, now or in the future, and any content including, without limitation, agronomic product service offerings, carbon product service offerings, SMS-based preliminary indications, indication acceptances, binding contract offers and acceptances, market data, price information, connectivity, contract confirmation, and messaging.
The Services may be made available to you through any of the existing and future electronic systems, APIs, SMS platforms and other platforms (collectively, the “Systems”).

Mobile Information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Indigo will not sell your phone number. Phone numbers and text messaging originator opt-in data and consent will not be shared with any third parties, except (1) if you consent to our sharing of such information, including for the purpose of providing services to you, (2) in connection with a sale, merger, or transfer of all or a portion of our business or assets to enable such transfer, (3) if we believe disclosure is required by any applicable law, rule, or regulation or to comply with law enforcement or legal process.
All Other Personal Data
So that we may use your information for the purposes identified above (see Section 5), we may disclose it to external providers of services, for example, without limitation, entities providing validation services, crop analysis, providers of security, marketing and IT services, also, to the extent applicable, your information may be disclosed to potential buyers in order to help facilitate the creation of bids and offers. We may also outsource certain functions of our business.
We may disclose Personal Data to related entities for the purposes identified above (see Section 5). You may receive communications directly from these entities in order that you may receive information about products, services and/or event that may be of interest to you. We use reasonable endeavours to ensure that these companies do not breach any U.S. laws, however, we disclaim all liability for any unlawful use of your Personal Data by an affiliated or associated company.

We do not knowingly intend to collect information from or direct Indigo Services to children age 16 and under. If Indigo learns that information has been received from a child under 16, then Indigo will delete such information.
Indigo retains your Personal Data only for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or allowed by law or to otherwise fulfill a legal obligation. For the purpose of business continuity, Indigo backs up your data within the Indigo infrastructure. As soon as these retention periods are complete, the data will be deleted or properly anonymized in order that you may no longer be identified from it.
Indigo may contact you by phone, email, text or via other electronic communication to provide you with marketing information and materials about Indigo products or services that may be on interest to you. If you do not wish to receive such communications, you may contact Indigo or, as applicable, follow the unsubscribe options provided in the electronic marketing communications.
From time to time, we may change and post revisions to this Privacy Policy and such changes to this Privacy Policy will become effective upon the posting of the revised Privacy Policy on our Site. Your use of our Site following these changes means that you accept the revised Privacy Policy.
The following terms are specific and controlling with regard to the types of mobile applications (to the extent applicable) referenced below:
iOS Mobile Applications (the “iOS Apps”)
Indigo collects usage data and technical information to conduct mobile analytics for internal use in order to increase the usability of the iOS Apps. This data will not be shared with third parties or utilized to track users across other third party apps unless the iOS Apps first request and obtain your permission before collecting analytics, and providing you with the right to opt-out at any time for any tracking or sharing purpose. Indigo does not share your location data with third parties except if required by law. The iOS Apps are intended only for users in the United States; do not use these applications outside of the United States.
Android Mobile Applications (the “Android Apps”)
Indigo collects usage data and technical information to conduct mobile analytics for internal use in order to increase the usability of the Android Apps. This data will not be shared with third parties or utilized to track users across other third party apps unless the Android Apps first provide notice to you of such use for tracking or sharing purposes. Indigo does not share your location data with third parties except if required by law. The Android Apps are intended only for users in the United States; do not use this application outside of the United States.
If Indigo performs business in the State of California, California residents have rights under the California Consumer Privacy Act and may: request (a) information pertaining to the Personal Data about you that Indigo collects, uses and discloses and (b) deletion of your Personal Data collected by Indigo by contacting Indigo as set forth in the contact section or by contacting via phone at 1-855-915-3399. Your exercise of these rights will not result in discriminatory treatment or a lower quality of service to you. Indigo has not sold consumer personal data of California residents in the last twelve months.
If Indigo performs business in the state of Connecticut:
Indigo, and related U.S. entities Indigo Agriculture, Inc., Indigo Carbon PBC, TellusLabs, Inc., Ecometrx, LLC, comply with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Indigo has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Indigo has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. The Federal Trade Commission has jurisdiction over Indigo's compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF.
In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Indigo maintains contracts with third parties to whom we transfer your personal data for the purposes described in this policy. These contracts restrict the third-party recipient’s access, use and disclosure of personal data in compliance with our Data Privacy Framework obligations, including the onward transfer provisions. Indigo remains liable if the third-party recipients fail to meet those obligations and Indigo is responsible for the event giving rise to damage.
In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Indigo commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF to the ICDR-AAA IRM Service. If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles-related complaint to your satisfaction, please visit the page ICDR-AAA DPF IRM Service Information for more information or to file a complaint. The services of ICDR-AAA are provided at no cost to you.
For residual complaints not fully or partially resolved by other means, you may be able to invoke binding arbitration as set forth in Annex I of the DPF Principles, provided that an individual has invoked binding arbitration by delivering notice to Indigo and following the procedures and subject to conditions set forth in Annex I of the DPF Principles.
